Bernie Tiede writ not yet filed
Carthage — Convicted murderer Bernie Tiede remained Monday in the Panola County Detention Center, awaiting filing of a writ of habeas corpus that would start a process leading either to his release or return to prison.
Found guilty of the 1997 murder of Marjorie Nugent and sent to prison in February 1999, the one-time Carthage funeral home attendant and subject of a 2011 feature film was returned to the Carthage lockup a week ago today.
Tiede is serving a life sentence but potentially could be freed on bond if a successful writ of habeas corpus takes his case to the state’s highest criminal court.
Several criminal defense lawyers contacted Monday said it was unusual, but not unheard of, for a prisoner to return to the convicting trial court before a writ of habeas corpus is filed. They said the writ usually comes first.
