Byron Truvia hearing

TYLER - Byron Truvia had another hearing today at the Smith County Juvenile detention center.

Truvia was not there, but his mom Denise was, however she did not comment to media.

James Huggler, Truvia's attorney was also there and says based on a mental health evalution out of Fort Worth he believes his client is not fit to go to trial.

Huggler says Truvia has a severe mental illness and a low IQ which Huggler thinks should make Truvia go straight into a mental facility instead of jail for his capital murder charge.

I AM SORRY THIS HAD TO HAPPEN. BUT WHEN IT COMES TO MENTAL ILLNESS IN THE STATE OF TEXAS, THERE IS NOT A LOT OF HELP OR RESOURCES FOR THIS. TEXAS RATES AT THE BOTTOM OF THE LIST WHEN IT COMES TO MENTAL HEALTH. WHEN BUDGET CUTS TAKE PLACE IT IS ONE OF THE FIRST TO GET FUNDING CUTS. ALSO A REALLY GOOD FRIEND OF MINE ON AN ELITE POLICE FORCE IN EAST TEXAS TOLD ME "THERE IS NO LAW AGAINST BEING CRAZY, WE CANNOT JUST LOCK THEM UP"; THEY HAVE TO COMMIT A CRIME BEFORE THEY CAN GET SOME HELP.

It is apparent that Byron Truvia was mentally competent enough to know where to stab the fatal blows that killed Mr. Henry. If he were truly mentally retarded to the point of not knowing what he was doing, he wouldn't have known to do that. To say that he is too mentally ill to stand trial is just a "politically correct" ploy that his attorney is using to placate the mother. Remember, she already accused this attorney of being biased against her son.

Truvia should be tried as an adult. If allowed to remain caught up in the mental health system, he will continue to be a danger to many, many people. If he is so mentally ill that he cannot be tried (a ploy in his part to avoid owning his crime), then he cannot be trusted to govern his behavior in a mental health clinic. Have you ever heard of a "shank"? A shank can be made from anything...and used as a weapon.

You just can't have it both ways. If he is unfit to be tried - then he is unfit to be in a mental hospital. If his mental state drives him to kill people - then he needs to be locked up like the animal that he is.

This teacher had warned the school before about this kid. He obviously had major issues. Maybe we should listen to our teachers and give them back some of the authority that has been taken from them. The student should have been removed from the classroom at the advice of the teacher. Then maybe our teacher would still be alive and this dude would have gotten the help he needs. Its unfortunate that a major crime has to be committed before any action can be taken.

well they need to talk to the people that was there when it happened. I think they should try him a an adult and he should get like in jail. that teacher was one of the best teachers. he would do anything for his kids.
