Civil suit against Good Shepherd, Diagnostic Clinic heads to trial

A Gregg County woman’s civil suit against the Diagnostic Clinic of Longview, Good Shepherd Medical Center and a local podiatrist goes to trial this week.

Attorneys in Kathryn Pepper’s case against Dr. Mark Witt continue jury selection this morning in Gregg County’s 124th District Court.

Pepper accuses Witt, Good Shepherd and the Diagnostic Clinic of negligence or malpractice for failing to provide reasonable care during and after Pepper’s surgery in 2007 at Good Shepherd in which Witt was to repair Pepper’s ankle and remove a lesion from her ankle. It was Witt’s first time to perform the surgery in private practice, and he used a bone saw during the procedure, which Pepper’s lawyers say was “an improper and unauthorized procedure for a podiatrist to operate on an area above the foot,” according to court documents.
