An East Texas man accused of beating his wife was indicted Monday for murder. The indictment supplanted an assault charge.

Kelly Gage, 52, of Gun Barrell City, was already being held in the Smith County Jail on a $200,000 bond for an April 15, 2014, assault on a family member. He remains in their custody.

Gage's wife was allegedly beaten by her husband back in 2011 on Thanksgiving night. In an interview with KETK, her son, Nicholas McHugh claimed Gage tried to kill him, too.

McHugh also stated the alleged Thanksgiving attack wasn't the first time she had been beaten.

"I believe he went into a rage. He did something to my mom, he has a past history of hitting my mom. In Washington, he cornered her in the bathtub and was grabbing her hair and slamming her head into the tile," McHugh said. 

Gage would only be charged with aggravated assault, due to insufficient evidence.
