Following Thursday's "improper photography" arrest: What's legal, what's not?

Thursday, 55-year-old Dennis L. Brown was arrested outside Woodcreek Athletic Club in Tyler.

Brown is suspected of taking improper pictures of women at that location and outside Robert E. Lee High School.

This prompted us to look further into what the laws are when it comes taking photos of people without their consent.

Attorney Bill Rosenstein says it's not illegal to take pictures of other people in public, unless they are taken with the intent to arouse or gratify the sexual desire of any person.

Brown admitted to police that the pictures were for his own "sexual gratification."

Brown was being held in the Smith County Jail on $5,000 bond, but was released Friday.

When the guy in our local neighborhood bar and grille said he wanted to watch the Olympic Volleyball match being shown on TV, I wanted to call the cops. I knew this disgusting perv had lewd thoughts on his mind, I could tell by the way he looked at our waitress in her low cut top. Can't we insist that women cover-up their bodies and faces so we deny these pervs the opportunity to think lewd thoughts?

Why are Playboy magazines allowed to be sold if the photographer broke the law taking the pictures and if you argue those pictures are taken with consent then I argue that consent is not the basis of the law as argued by Rosenstein, purpose is.
