WASHINGTON (AP) - The Obama administration says it will no
longer defend the constitutionality of a federal law that bans
recognition of same-sex marriage.

In a statement Wednesday, Attorney General Eric Holder says
President Barack Obama has concluded that the administration can no
longer defend the federal law that defines marriage as only between
a man and a woman.

The Justice Department had defended the Defense of Marriage Act
in court until now.

I thought we had 3 branches of government for a reason? And if memory is still wit hme after 35 year absence from High School isn't the Prseidency a member of the executive branch, and not the judicial branch. Either the POTUS is being ill advised or he just doesn't think the constitution or our framework of government apples to him. From his past actions I think it's the later.
