Judge rules for appraisal district in tax law case

A district judge in Longview ruled Thursday that sections of a new law on how heavy equipment is valued for taxes are unconstitutional, a ruling that could have a big effect on taxing entities and taxpayers.

Judge David Brabham’s decision provides a temporary victory for the appraisal district while this and a host of other cases statewide work their way to the appellate level and beyond.

“These cases are all over the state,” said Pat Mizell, attorney for a Kilgore heavy equipment dealer that argued Nov. 8 that a law taking effect in 2012 drastically lowered the taxable value of natural gas compressors worth millions of dollars.

John Kennedy, senior analyst with the Texas Taxpayers and Research Association, previously said the outcome of this and other cases could have tremendous impact on all taxing entities and those who pay taxes.
