Mike's Mail Bag: Should alleged 9/11 terrorists be tried in New York?

November 23, 2009 - 6:53pm

TYLER - Michael Wesp wants to know what you think about today's issue: should the alleged 9/11 terrorists be tried in New York?

There really is no mark to miss. We capture and retain prisoners during a "war" on terrorism, remove them from their country, ignore the World court in the Hague, roll our eyes at the Geneva Convention, to which we once adhered like grownups, and now find ourselves all wadded up because we are just terrified that we don't have the starch in our breeches to try these guys on our own turf....pathetic.

Why not? Do we have a case...after all these years? If we can't try them in New York, is it because we have something to hide? If a military tribunal is that much preferable to a New York trial, why not try everyone that way? If the worry is that we might make martyrs of the detainees, it's too late. Holding them all these years at Guantanamo has largely accomplished that. March them in, make the case, and try them. And while we're at it, how about adding the good folks who were asleep at the wheel and allowed 9/11 to happen despite clear intelligence warnings. Let's get this done and move on.

I believe you are missing the mark on this. These terrorists are not U.S. citizens and do not deserve the rights of our legal system. These people were captured on a battlefield as enemy combatants and should be tried in tribunals as other enemy combatants have been tried for nearly a century of our history. The Germans who were responsible for the atrocities committed during the Holocaust were tried in military tribunals, as were the Japanese responsible for the attack on Pearl Harbor.
Bringing these terrorists into federal courts could and should lead to their being found not guilty. I say this because according to our laws and the rights included in our Constitution and Bill of Rights, they could not be found guilty. These people were not Mirandized, nor were they given a speedy trial. They were not afforded legal representation, and the manner in which they confessed would make any trial impossible (although the "torture" interrogation techniques have saved numerous American military lives).
The third problem with this is that the trial will result in confidential information and interrogation techniques being broadcast throughout the world. This will only help our enemies when they are captured. And on that note, when we capture Osama Bin Ladin, do we have to read him his Miranda Rights on the battlefield? Are we going to require all of our military members to be licensed law enforcement personnel also? That would be the only way this would work. Oh, wait a minute, we cannot use our law enforcement in other countries... So there is no way that this could possibly work. And if you are so intent on punishing those who could have prevented 9-11, first on the list should be President Clinton, who had Bin Ladin in his sights and refused to pull the trigger when he had the chance.
As a final note, the poor people in New York have to relive this horror. This trial will make them an even bigger terrorist target than they already are. So the people in New York will have to live in fear of another attack during the entire circus they call a trial. Have you seen all of the family members of those who died on that day protesting this? They don't want to relive the worst attack on American soil in our history. Please, drop your ideals and look at the reality.

Andy, you are quite mistaken about this quote.
The correct translation reads, "You shall not murder".
The civil and military authorities do not MURDER people,
they carry out lawful, and God approved punishments.
But many people make the same mistake as you in this
instance.
