Nacogdoches man charged with intoxication assault

A Nacogdoches man is being charged with intoxication assault after he wrecked his truck on U.S. Highway 59 north two weeks ago, severely injuring his passenger.
Mitchael Shane Starling, 44, rolled his vehicle on U.S. 59 Oct. 29, throwing his passenger, Melanie Leatherman, 38, from the 2000 Dodge truck. Leatherman was found unconscious by EMS workers and later flown to East Texas Medical Center Tyler with a head injury. Trooper Joseph Wood could smell alcohol on Starling, and his eyes appeared red and glassy following the accident, according to an arrest report. Initially, Starling said he was not driving the vehicle, but later admitted to Wood that he was, the report stated. Starling's blood alcohol contest tested at .16, twice the legal limit, the report stated.
He was booked into the Angelina County Jail on a DWI charge, but after Leatherman had not regained consciousness Nov. 2, Starling was charged with intoxication assault. It appears Leatherman has a severe brain injury as a result of the accident, according to the report.
