AUSTIN, Texas (AP) - According to the associated press; an Arlington City Council member told a federal judge in Austin that the Texas Open Meetings Act muzzles municipal officials and impedes their ability to fulfill their duties.
Attorneys from the Texas Attorney General's Office told U.S. District Judge Robert Junell, however, that the law muzzles nobody, but it does present an obstacle to government by secret. Junell who presided over the one-day trial of the lawsuit.
Junell previously ruled that the law doesn't violate elected officials' free-speech right, but an appeals court ruled otherwise and reversed the ruling. The Austin American-Statesman reports Junell ordered additional briefs to be filed by late January and that no decision is expected before February.
