Pining for Rights to a Tree

August 1, 2009 - 4:55pm

RUSK - A Rusk family is pining for property rights. With an attorney on their side, they are challenging a utility company's intention to cut a tree.

They have spent almost $7,000 in legal fees and rallied support throughout the city of Rusk to try and save this tree from being chopped down.

This giant pine was spared a few days ago thanks to the Jackson's after Wright tree service were contracted out by Oncor electricity to take down the tree because it was on the utility right-of-way.

But Oncor soon found out they were barking up the wrong tree.

"We've given them permission to take the final limb, we've asked them to straighten their poll or replace their poll because its going to give way soon," Marty Jackson says.

Mrs. Jackson says next time they come back to try and cut it down again, they'll be ready.

"I'm going to win this. It isn't coming down."

Mrs. Jackson't son jokingly ran for Mayor in Rusk this year. He called himself a Conservative, they sound like tree hugging hippies to me. Oncor has a job to do because the tree is on a utility right of way. These people are obviously starving for attention.

And how about when her tree knocks my power out or her neighbor a couple streets down who is on oxygen. What about the businesses trying to stay 1 step ahead of going out of business and cant afford to miss the money from one lunch run. The elderly couple that needs that air conditioner to run when its 102. This woman thinks of no one but her self, and just you watch she will ya’ll the loudest when her power goes out.

I would fight for my trees, too! I have a HUGE pine that I'd fight for if anyone wanted to try and cut it down.

We have a big elm in our yard, and last year, the co-op was doing trimming. We explained that we loved the tree and asked that they only removed what was necessary, and that is exactly what they did. We still have a beautiful tree and they have their right-of-way. HURRAH for
Co-ops!!!! I'd hate to try and fight OnCor!
