Houston DA says DNA tests on hairs found at scene of rape prove Rodriguez didn't commit the crime.

Prosecutors plan to ask a Houston judge to dismiss a 1987 rape conviction that kept an innocent man in prison
for 17 years be dismissed.

The Harris County District Attorney's Office says DNA tests on hairs found at the scene of the rape proved that George Rodriguez didn't commit the crime.

Rodriguez is 50 now and has been free since a court ruled in 2004 that faulty evidence was presented at his original trial.

The case was later dismissed amid concerns the rape victim would have to testify at another trial.
