Republican Party of Texas threatens to sue Cherokee Co.

In August, the Cherokee County Commissioners Court voted to pass a list of election judges for the 2014 November ballot. However five of those judges elected as Republicans, are actually hard Democrats.

So the Republican Party of Texas sent the commissioners a letter, threatening to sue the county if the list is not changed. The letter reads, "In the event you do not comply with this request…. the Republican Party of Texas will be forced to seek mandamus relief from the Twelfth Court of Appeals".

KETK spoke with Katherine Pinotti, Precinct 1 Commissioner, who said, "I was actually pleased. I was. Because I knew what transpired was incorrect, but I did not think it would be corrected so quickly". 

The GOP Chair submitted a list of preferred judges to the court, but the Elections Administrator claims those names were not provided before the deadline. However the letter reads, "Neither the facts nor the law support this position. Chair Morris did submit the names prior to the last day of July… the Elections Administrator is required to make a reasonable effort to consult with the appropriate party chair".

Commissioner of Precinct 1, Kelly Traylor, said, "It's [the letter] stating the Commissioners Court did not follow the law. But it's my understanding that we did". 

The court has two days to respond. Pinotti said, "We need to go back and properly amend what was voted on in our last session".
