Roadside produce stands are all over east Texas right now.

But for those who want to sell more than just a whole fruit or vegetable, it's a whole different ball game.

"Once they want to sample, want to cut and slice and dice, that's when a temporary food establishment permit would be required," said Ginger Wood of NET Health.

Wood says anybody is allowed to sell whole produce, but as soon as a seller breaks that fruit or vegetable open, the rules change ... and some vendors don't follow them.

As far anything that is canned or packed goes ... 

"Jelllies, jams, canned bottled honey ... it's a produced item now that does require a state manufacturing permit," Wood said.
