UPDATE (November 16th, 2012 - 12:40pm) - Simon Lopez entered a guilty plea Friday morning in the 7th Smith County Judicial Court.

Judge Kerry Russell was the presiding judge.

Lopez was sentenced to life in prison for the murder of Emma Torres' one year old son, Jeremy Silva, back in 2010.

Authorities say Silva died from blunt force trauma.

Lopez had been watching him at the time. He called Torres' relatives to tell them that the boy wasn't breathing, but then fled the scene.

He was later arrested in Mexico, and was arraigned on Capital Murder charges.


UPDATE (October 8, 2012): Emma Torres, the mother charged with the 2010 death of her one-year-old, has avoided a murder charge Monday.

According to Smith County court documents, Judge Kerry L. Russell sentenced Torres, 21, to two years in a state jail facility for child abandonment/endangering a child after she plead guilty.



Torres was also facing a capital murder charge, but that was dropped Monday after the District Attorney's Office filed a motion to dismiss it on August 20.

Torres and her boyfriend, Simon Lopez, 28, were indicted back in September 2011 for the death of Torres' one-year old son, Jeremy Silva.

An autopsy determined Silva died from blunt force trauma. Investigators say Lopez was watching the child in November 2010, when he called one of the mother's relatives to say the boy wasn't breathing. Tyler police say Lopez left the youngster with the relative and fled. In July, he was caught in Queretaro, Mexico.


Both suspects entered a not guilty plea on January 24. The charges against Lopez remain in place.

Torres is currently being held in the Smith County Jail.
 


UPDATE (January 2012): Two suspects enter not guilty pleas in the death of a one year old boy. Simon Lopez, 27, and Emma Torres, 19, are charged with killing Torres’ son, Jeremy Silva in 2010.

According to our news partners, KTBB, the pleas were entered on Tuesday in State District Court in Tyler.

Police say Lopez was watching Silva while Torres worked. He reportedly called one of her relatives to say the boy wasn’t breathing.

Investigators say Lopez left the boy with the relative and fled. Autopsy results show the toddler died from blunt force trauma.

Lopez was arrested in Mexico, and transported to Houston, where he was arraigned on Capital Murder charges before being transferred to the Smith County Jail.

A trial date has not been set and prosecutors have not announced if they will seek the death penalty.
