Houston, Texas (NBC) — In Texas, Police say a father shot and killed a boy he found in his daughter's bedroom in the middle of the night.
The girl at first denied knowing the boy, but police have since learned they were friends.
It will be up to a Houston area grand jury to decide if charges will be filed.
The family of Johran McCormic, 17, cannot understand how or why he died.
"He don't have no weapons, he's not that type of kid. No play guns, not water guns, no beebee, no nothing," said relative, Shanell Curley.
McCormic was shot and killed while secretly visiting a girl in a home in north Houston.
The girl's father told investigators that he heard noises coming from his daughter's room around 2:30 a.m. When he went to investigate, he found McCormick in his daughter's room.
Police say he initially denied knowing the boy.
The father called 911, but before police arrived, the man told investigators the boy appeared to be reaching for something.
"There was some type of altercation and the father shot the male one time," said Harris County Sheriff's Office Sgt. Ben Beall.
"He didn't have to shoot him, he didn't have to shoot him in the head," said cousin, Zakia McCormick.
It turns out McCormick and the girl were friends. Police say she let McCormick into the house and snuck him into her bedroom.
"He was not a stranger. We don't know if the father knew him or not," said Sgt. Beall.
The father was taken to a local hospital, suffering from what poliec say was a panic attack following the shooting. No charges have been filed.
Harris County Sheriff's Office has announced that the case will be presented to a grand jury.
"For his life, just to be taken away from us like this, it hurts. It hurts," said Curley.
Now, instead of enjoying spring break, McCormick's family is planning his funeral.
