tyler — A Tyler couple accused of killing a toddler were back in court today for a hearing.

Simon Lopez, 27, and his girlfriend, 20-year-old Emma Torres, were indicted back in September 2011 for the death of Torres' one-year old son. Both are charged with capital murder.

An autopsy determined Jeremy Silva died from blunt force trauma. Investigators say Lopez was watching the child in November 2010, when he called one of the mother's relatives to say the boy wasn't breathing. Police say Lopez left the youngster with the relative and fled. He was caught in July in Queretaro, Mexico.

The pair is scheduled to be back in court on May 4.
