The Sheriff’s Department in Cherokee County is going through the records of a local commissioner, and the results may be brought before a grand jury.
 

Cherokee County Precinct 3 Commissioner Katherine Pinotti is in hot water with her peers. And it all revolves around gravel…

Patterson Road is the thoroughfare in dispute. The commissioner says that after much research she discovered it is mislabeled as private on county maps, and is actually county road 3427.  And so, at the request of residents, she had the road resurfaced with gravel.
 

County attorney Craig Caldwell, and other commissioners are questioning the move, and an investigation has begun.
 

A warranty deed for the developer of that rural subdivision says…that the road, now known as Patterson Road, is private, and if residents want the county to maintain it, they must file for formal approval from Commissioners Court.
 

Pinotti has retained former District Judge Cynthia Kent to represent her, and is no longer talking to the press.
 

Leading the investigation for the Sheriff’s Department is Captain John Raffield…
 

“The deeds have been pulled and all the documentation from the county,” Raffiled told us. “And the information we’ve gathered so far indicates that it is not a county road in Cherokee County.”
 

Raffield says that the amount of money spent on the project would determine whether this could be a misdemeanor or a felony.
 

Pinotti told us two weeks ago, she felt this was purely political…
 

“Yes, it’s pretty much a witchhunt, and I’m getting tired of it,” she said
 

Raffield says that the investigation should take a couple more weeks, and will be ready for the DA in early October.
 

Cynthia Kent was in meetings all afternoon, and not available for comment.
