Smith County authorities released Kelly Gage from jail shorlty before 1 p.m. Tuesday.

Gage's bond was dropped from $1 million to a $10,000 personal recognizance bond.

The man police say is responsible for beating his wife so badly back in November, that she later died from her injuries, will walk out of the Smith County Jail Tuesday.  But, there is a reason that Kelly Gage will walk out a free man.  KETK spoke with Smith County District Attorney Matt Bingham to explain why this will happen.

Watch the video above for more on this story.

*KETK will also be posting the interview with Matt Bingham in full.

Mr. Howard. My mother was not stoned, she was intoxicated but so was he. His biggest story is that he blacked out and doesn't remember anything. I have been living in a nightmare with him for 12 years that finally came to a brutal end.

Facts are, Patti was drunk 4.5x the legal limit, Patti was suppose to be caring for her special needs child, thats neglect, Kelly was an abusive husband who had beat her before,Patti stayed,Kelly also threatened to kill her older son,so he had to move out,Patti still stayed,Kelly was a horrible person & liked to beat her every 6 or so months when drunk.Pattis team of investigators say due to her TOX report & NO evidence that she didnt just fall,WHILE so drunk, they cant say that Kelly did this

According to toxicology reports this woman was stoned and drunk out of her mind. Maybe she did fall. She should have stayed sober.

Mr howard patty was a friend of mine and kelly gage beat her to death . He had beat her before and was slapped on the hand and told bad boy just dont do it again .I do not belive she fell like he said .I went to the hosipital and saw the damage he did.Did you? If not you have no right to say any thing about patty

Smith County Jail is a dangerous place for any citizen to be.
