UPDATE (November 19, 2012): A trooper who was involved in a wreck in early November has been arrested for Driving While Intoxicated during that incident.

Smith County DPS Trooper Joe Don Abernathy was booked into the Smith County Jail just after 1:30 on Monday afternoon.

He was released about 15 minutes later on a $1,000 surety bond.

Abernathy crashed on November 5th after allegedly swerving to miss a deer on Old Omen Rd. in Tyler.

He resigned from his position as a DPS trooper the next day, November 6th.


ORIGINAL STORY (November 5th, 2012): A DPS trooper was involved in a car accident Monday morning on Old Omen Rd. in Tyler.

It happened near the Arrowhead Golf Course around 7:20am.

According to Smith County DPS officials, Trooper Abernathey swerved to miss a deer than ran out in front of him, and ran off the road.

The DPS unit was the only vehicle involved, and it is said to have substantial damage.

Trooper Abernathey is currently being checked out by medical officials.

The roadway is not blocked at this time.

Texas State Troopers are Jerks. If they ask to search your car, and you say "no", they will detain you until a drug dog arrives, sometimes taking two hours. No matter what, they still get to search in spite of one's objection. I travel I-20 every day and see it constantly. Glad to see one you pricks go down!

He should be fired immediatly and have to pay for the damage to the car. However, as he is one of the good ole boys, he will probably be back at work as a trooper in a week, with no punishment.
