Upshur County Commissioners delay appointing interim county judge
GILMER, TX — Upshur County Commissioners on Thursday delayed appointing an interim county judge by two weeks to further review the issue for legal matters, noting that the wait won't hold up their budget.
Commissioner James Crittenden asked the court to consider the appointment after receiving an opinion from District Attorney Billy Byrd that said the court could not complete its 2011-12 budget without a county judge in place. Judge Dean Fowler has been suspended pending a ruling on a case in which he is charged with official oppression and abuse of official capacity, along with Sheriff Anthony Betterton and Commissioner Lloyd Crabtree.
"We've got a good county judge and we've got a court hearing today," Crabtree said, noting that it wasn't urgent to appoint a judge immediately.
"And as soon as he is acquitted he can come back," Crittenden said. "We've got to start working. The sooner, the better."
