Wood County Bombshell

The appeals process in the Mineola swingers case is underway, and a surprise was introduced that may send shockwaves through Smith County.

Oral arguments began yesterday in the cases of two defendants in the so-called Mineola Swingers Club.

And a legal hand grenade has been tossed in the middle of things from a neighboring county…and a neighboring district attorney…

The appeals of Patrick Kelly and Jamie Pittman, who both were sentenced to life in prison for their part in the alleged child sex ring, began
Tuesday in a teleconference with the Houston based 14th Court of Appeals.

But a bombshell from Wood County has turned everything upside down.
Wood County District Attorney James Wheeler filed an amicus brief alleging that the Smith County District Attorney’s office lied and suppressed and or withheld evidence in the case.

A grand jury heard the case in Wood County and no indictments were handed down because they saw no evidence of a crime.

Wheeler says the owners of the club were interviewed by District Attorney Matt Bingham’s office, and testified that no children were ever in the club.

Matt Bingham says it isn’t true.

The California accusations against the foster parents of the children involved, accusations of child abuse, were lied about, according to the brief.

Davidson was stunned… DA Matt Bingham is angry…

"Frankly the district Attorney's office who did anything they could, lied, hid evidence to get a conviction...These people need to face punishment," said Davidson

Bingham retorted, "They can say Matt Bingham's a bald-headed ass, but when they challenge my integrity, that makes me mad."

It might take as long as two months for the appeals court to render a decision.

I wouldn't have convicted any of the six people. There was'nt enough evidince. We can't believe everything that a child says. I guess I can say this because I know four of the childen involved. They have very big imaginations. You take adults they don't know, talking to them for hours and putting word's in thier mouth. They would say anything, so they could get away from them and go outside to play.
These three that are in prison now are very innocent of these crimes they were convicted of. I would hate to be tried in the smith county court, with the judge that tried these people. I don't think if you had the best lawyer you could find, on a crime like this, you wouldn't have a chance in smith county court. Someone is always trying to make a name for themself.

It seems to me that Bingham and others in the DA's office should be charged with official oppression, tampering with a witness, and suborning perjury, at least. Skeen should also be charged with official oppression and maybe other things depending on how involved he was. I wonder if the Appellate court can appoint a special prosecutor. I think that would be a good idea. This behavior is not going to stop until some of these people go to jail.

there will not be an honest or fair department in east texas until the crooked smith county sherrifs department is cleaned out.

Does anybody know whatever happened with the case of the handgun instructor who let his kindegartener take a gun to school? Was he ever prosecuted? If not, I wonder why.

Maybe, just maybe the voting poll is rigged. Uhmmm I wonder, just a thought.

Wow, how does the Smith Counth DA know who is on Mr. Davidson's email list and what content may have been in some emails. Mr. Davidson, either 1) you have a "friend" that you should re-consider; or 2) "someone" is intercepting private convestations. Citizens make your choice carefully. Is BIG BROTHER watching. I am sure there is a warrant available to monitor personal conversations. Or again, Mr. Davidson be careful of who you email. Please, keep up the fight. Last time I checked we are a REPUBLIC. Long live the CONSTITUTION.

By the way, Bingham is not just a bald-headed ass. He's a lying bald-headed ass.

The line about Bingham being mad about his integrity being attacked is really funny. Bingham has no integrity. No one should be surprised. This type of behavior is typical for the Smith County DA's office and has been for more than 30 years. As the judge in this case, Jack Skeen made up exceptions to the hearsay rule, allowed people who were not experts to give expert testimony and did whatever he could to make sure the DA's office won this very weak case. Why do the voters of Smith County keep electing these crooks?
