TYLER - Imagine being exposed in the most humiliating way... when a private moment is caught on camera and shared with the world.
Case in point— Boyles v. Kerr in the early 90s. A girl has sex with her boyfriend in the privacy of her home. What she doesn't know is the guy's buddies taped the whole thing... and passed it around.
That case actually sets precedent for Video Voyeurism— secretly taping someone for sexual gratification. The Texas Supreme Court decided you can't get civil damages for negligent infliction of emotional distress. So what about intentional?
Attorney Blake Bailey says, "You could theoretically get damages awarded to you, but intentional is not covered under insurance policies, and negligence is. I don't know the logic behind the Supreme Court opinion, but I can tell you that they pretty much immuned insurance companies from having to pay anything with the policies they may have had with these young men."
So except for filing criminal charges... are you just out of luck? Bailey says... not so fast. You may have some options. That's why you need to call an attorney.
He adds, "I think that one of the most important things is that especially women need to stand up for their rights and not be embarrassed because sometimes people get away with things as bullies, that they shouldn't be able to get away with."
