Tyler, TX (KETK) — “Democratic Senator Joe Biden of Delaware joins us. He is a member of the Senate Judiciary Committee. He joins us this morning,” says Harry Smith. “The fourth amendment is supposed to protect us from unreasonable search and seizure, do you think this big grid pattern passes that test?”
“I don't think it passes the test, but it clearly doesn't pass the test to existing statutes that say you can’t do these types of things forgetting the fourth amendment, “ replies Biden. “Harry, the bottom line here is, you have the president making a judgment that is not reviewable by Congress and we're supposed to say okay? It’s like the bank turning over all your check records without your name and giving the check numbers for every single purchase made. It patterns your behavior. You were told don't worry. That it’s not an invasion of your privacy.”
Smith responds, “The president said he would not listen to your phone calls.”
“Harry, I don't have to listen to your phone calls to know what you are doing,” says Biden. “If I know every single phone call you make, I'm able to detect every single person who you talk to and that sets up a pattern of your life which is very intrusive. And the real question is, what do they do with all this information they collect that does not have anything to do with Al Queda?"
