Lufkin, Tx (KETK) — An Angelina County man is sented to 10 years for abusing a four month old baby.
Jimmy Brent McClelland, 26, had abused the child to a point that it suffered from a broken leg and showed symptoms of shaken baby syndrom in August of 2011.
According to documents, police were called to a local hospital on August, 12, 2011 for a baby with a broken leg. Police had spoken to the mother of the child, Mahala Ellis, who said that she was at work when she got a call from McClelland who had said the baby was hurt.
McClelland had spoken to detectives telling them he was rocking the child by placing the baby's feet against his chest and placing the baby's knees against his own stomach. McClelland was frustrated with the baby and got too rough in the manner he was rocking him when he heard a popping sound.
CPS later reported that the baby had suffered from retinal hemorrahaging that consisted with Shaken Baby Syndrome.
McClelland had explained that Ellis had left for work when the baby had started to cry in his swing. He picked the baby up by his leg with one hand, and the other hand was under his head.
He was sentenced at a hearing on Tuesday, June 18, 2013, McClelland pleaded guilty to charges of injury to a chld on April 9.
The child is currently doing well, but the brain damage that may have occurred because of the shaking will not be known until the child is in school.
The paternal grandmother at this time has custody of the child, and because McClelland had injured the child, Child Protective Services officials have decided that the mother, Ellis, was negligent to care for the baby.
McClelland is not the father of the child but has been helping raise him since birth.
