Gilmer, TX (Longview News-Journal) — A former Upshur County employee has filed a federal lawsuit against the county alleging wrongful termination.
The lawsuit was filed in January by former Upshur County Road and Bridge department employee Earnest Hoye in U.S. District Court in Marshall.
Upshur County officials are scheduled for court-ordered mediation Thursday. County Judge Dean Fowler said Tuesday he will attend the mediation hearing, which is not a public proceeding, with county attorneys.
Hoye, a 10-year county employee, claimed in the lawsuit that he was fired July 21, 2011 on the basis that he had been absent from work. Hoye said in the lawsuit that the actual reason he was fired was his absence from work on leave time protected by the Family and Medical Leave Act.
