LINDALE - Joshua Barnes is being held on a half a million dollar bond in the Smith County Jail on a murder charge.
Police say Barnes was arrested early Sunday morning and taken to jail after witnesses say he stabbed James Brandon Lee to death.
Lee and Barnes were aquaintances and were both at a Smith County Sheriff's deputy's house party on Saturday night.
That's when police say just after midnight Lee was stabbed by Barnes after the two got into a fight.
According to the police report-off duty Deputy Terry Lindsey, the home owner, handcuffed Barnes after the incident and waited for police to arrive.
Joshua Barnes told his father that Deputy Lindsey pistol whipped him after he was cuffed.
Reportedly-when police showed up to the house, Lindsey's wife Heather was holding a pistol.
That's when the officer took it from her, and according to the report put the pistol back inside the Lindsey's home.
Barnes' father says the pistol needs to be part of the investigation and used for forensics because he told us "my son's blood is on that pistol."
Smith County Sheriffs' spokesperson says all evidence is being looked at.
Another allegation from Barnes is that there was underage drinking at the party and he says Deputy Lindsey asked minors involved to leave before the cops showed up on the scene.
According to the police report-two witnesses did return for questioning on the events of the night.
But their ages were not visable to the public on the report.
