San Antonio — A judge has declared a mistrial in the trial of a 51-year-old San Antonio man has gone in the slaying of a man he suspected was an intruder in his house.
A Bexar County jury had been deliberating the guilt or innocence of Ray Lemes on Wednesday when they sent a note saying that a juror had independently researched the legal definitions of "murder" and "manslaughter."
Defense attorneys immediately requested a mistrial because of jury misconduct, and state District Judge Lori Valenzuela granted the request.
Prosecutors and defense attorneys both said the case will be retried.
Lemes was charged with murder in the shooting death last year of 19-year-old Angelo State University student Tracy Glass.
Prosecutors contend Lemes shot Glass repeatedly as he fled.
