SAN MARCOS — A judge next month will consider a plea agreement from a Central Texas teenager whose two accomplices were fatally shot during a 2009 home invasion.
Prosecutors in Hays County say 19-year-old Frank Castro of Luling (LOO'-leeng) last month agreed to plead guilty to aggravated robbery and burglary of a habitation. He would serve five years in prison.
San Marcos police say Castro and three other armed youths tried to rob an alleged drug dealer.
Someone in the house opened fire, killing 16-year-olds Rudy Tinoco and John Alvarez II. Castro wasn't hurt. The other youth was wounded and still faces charges.
Castro was later charged with capital murder, being held responsible for the deaths because he was involved in committing the crime.
The resident wasn't charged.
