The jury found Leroy Diamond Jr. not guilty of aggravated kidnapping and aggravated sexual assault, but found him guilty of sexual assault of a child. The punishment phase of Diamond's trial is beginning. Check  back for updates.
The state of Texas rested its case Monday in the trial of Leroy Diamond Jr. on the charges of aggravated kidnapping and aggravated sexual assault of a then 14-year-old girl.
The defense will begin its case at 9 a.m. Tuesday morning.
The girl, known as ET for protection of her identity, said in testimony Monday she was picked up in Nacogdoches by a man as she was walking to her boyfriend's house to ask for a ride back to her mother's home.
She was then taken to a remote area off a county road between Woden and Etoile on Wednesday April 21 where she said she was raped.
It was getting dark as the girl began walking.
"I told her to stay there (at her friends house,) and I was going to call and see if I could get her there to the house," the girl's mother said in testimony.
But after ET started walking, she said Diamond pulled up and asked her if she wanted a ride, ET said.
"At first I said no, then he told me he knew my dad and my mom, he said their names, said he knew me and that I was the youngest," ET said. "If he knew me, then he was close with my family and I got in the car and asked him if he could take me to my boyfriend's house."
The girl said Diamond passed the road to her boyfriend's house, but she thought he was just taking another way. Then, he passed one of her friends homes and she started thinking it was a time to be scared, she said.
