Harris County D.A. questions accuracy of alcohol breath tests

Harris County District Attorney who questioned the accuracy of mobile alcohol-breath tests the Houston police administers has been called to testify in a drunk driving case.

Although Pat Lykos is unlikely to appear in the trial because she is out of town, her words are expected to be heard by jurors Friday via interviews she gave local media.


County Court at Law judge John Clinton ruled Thursday that the top prosecutor's opinions on the breath-alcohol testing vans are relevant in the DWI trial. Defense attorney Jackie Carpenter asks why the DA's office is "prosecuting someone with evidence you deem unreliable?"

The Houston Chronicle reports that Lykos' testimony could affect dozens of past and future DWI cases that relied on evidence handled by the testing equipment in the vans.
