San Antonio man condemned for rape and stabbing is denied appeal
A federal appeals court has refused an appeal from a San Antonio man condemned for the gang rape and fatal
stabbing of a 15-year-old girl whose body was found in a park.
The ruling from the 5th U.S. Circuit Court of Appeals moves former street gang member Carlos Trevino a step closer to execution for the June 1996 slaying of Linda Salinas. She was killed one month after Trevino, convicted of auto theft, was released from prison.
The 36-year-old Trevino is one of four men convicted in her attack but the only one sentenced to death. Trevino's appeal argued prosecutors improperly withheld from his trial lawyers one of three statements from one of his companions.
A New Orleans-based 5th Circuit Court panel ruled 2-1 late Monday to reject the appeal.
