Day 6: Punishment Phase Of Mays' Trial Begins

HENDERSON COUNTY - The second phase of the Randall Wayne Mays' Capital Murder Trial continued Saturday.

Friday, a jury found 48-year-old Mays guilty of Capital Murder in the death of Henderson County Deputy Tony Price Ogburn.

Now, the jury must decide Mays' punishment-- life without parole or the death penalty.

Athens Police Officer Troy Harrod says, "They were two well-liked knowledgeable peace officers that lost their lives. It's what we face everyday. We can't ever bring them back. They will always be missed and never be forgotten."

Officer Troy Harrod knew Deputy Tony Price Ogburn and Investigator Paul Habelt very well.

Officer Harrod says, "Those two guys are like the two best people I've ever met in my life."

Investigator Habelt--

Officer Harrod says, "Whatever you needed. He was there for you. Whatever it was. Time was no essence to him."

Deputy Ogburn--

Officer Harrod says, "He'd come to work everyday with a smile and come to work with his bible in hand. He dressed nice, very polite, very professional."

Memories like these are what's kept the two men alive in the hearts of so many.

Especially in tough times like these.

Officer Harrod says, "We still try to think about the good times we had with them. This tragic event that we're all still going through, still plays a dramatic role. It's hard to get back to the good times."

On Friday, a jury found the man responsible, Randall Wayne Mays, guilty of capital murder in the death of Deputy Ogburn.

And on Saturday, began listening to more witnesses--- four people who've sacrificed so much.

The first on the stand, Mrs. Patricia Ogburn, Deputy Ogburn's wife of 36 years.

The state asked Mrs. Ogburn the effect her husband's death has had on her.

Mrs. Ogburn said, "I can't even explain it. The day I heard about it. I haven't been the same. I don't know if I'll ever be the same."

She went on to say, "I pray someday it'll get past me."

Mrs. Ogburn said, "He truly believed in being a police officer. That was his life."

Patricia and Tony Ogburn together have one son-- Tony Ogburn Junior.

He took the stand soon after his mother.

Emotionally, he said this, "I have nightmares. Not every night but quite often. I don't get any sleep. I'm always looking over my shoulder. I have a
different outlook on life."

He told the jury, he and his father talked on the phone everyday.

Tony Ogburn, Jr. says, "I don't know what to do sometimes. I can't call my dad anymore. I can't hear my dad's voice."

And sadly, says he'll have to explain that to his 7 children one day.

The youngest is 10 months.

His dad Tony never had the chance to meet her.

Tony Ogburn, Jr. says, "When my kids get older, I don't know how to explain to my kids why their grandfather is gone."

The deputy who survived the deadly shooting, Kevin Harris also took the stand.

He went on to say, "Not having Tony in my life is a devastating factor. It's something I think about everyday and dream about every night."

Deputy Billy Jack Valentine also took the stand again.

He explained to the jury how a tragic event like this, has forever changed him.

Deputy Billy Jack Valentine said, "There are times I don't even want to come to work anymore, but I do because they are my family."

For now, members of this family, will continue to await the punishment of Randall Wayne Mays.

All they can hope for, is the law will prevail.

The Defense did not cross-examine anyone on Saturday morning.

The punishment phase of the trial should wrap up at the beginning of next week.

Again, a jury will decide if Mays will get life without parole or the death penalty.
